Is it possible to extend a Canadian work permit?

Foreign workers have the right to extend their work permit to stay in Canada if the work permit is still valid.


Can an employer cancel a work permit?

Three entities have the right to cancel the employee’s work permit:

  • The employer
  • The sponsor
  • The employment agent

Before canceling the work permit the following must be checked:

  • Mutually agreed last day of the work
  • Settling all payment issues/ outstanding between employer and employee
  • Ensure the employee has a valid passport
  • If the employee wishes to leave the country, then the employer must provide him/her with an air ticket back home

Can an individual work in any province in Canada with a valid work permit?

Only a foreign worker holding an open work permit can work from anywhere in Canada and can change employers as well.


What’s the difference between an open work permit and closed work permit?

An open work permit allows the holder or foreign worker to travel to any province and work for an employer there.

The best part about the open work permit is that a job offer or a positive LMIA (Labour Market Impact Assessment) isn’t required.

Who is eligible for the open work permit?

  • Family dependent
  • Spouse
  • Temporary resident permit holder
  • International students who are unable to meet the cost of their education
  • Refugees

The closed work permit is minimal and strict in terms of rules compared to the open work permit. It allows the holder/individual to enter and work in Canada for a minimum period before they are capable or eligible to apply for a permanent residency in Canada.

To prove its closeness, the work permit includes the name of the employer, the period/term of the contract, and the work location (address and province).


What are the requirements of a work permit?

Below are the documents/proof necessary to apply for a Canadian work permit:

  • Education
  • Resume
  • Proof of work experience
  • Work visa application
  • Passport with 6 months validity
  • Proof of financial funds
  • Work contract / job offer
  • Health insurance for the applicant
  • Letter of experience for previous employers
  • Other supporting documents in case the applicant has a spouse of children below the age of 18

What is LMIA?

LMIA, known as Labor Market Impact Assessment, is one of the documents the Canadian employer needs to hire foreign workers. The LMIA, sometimes called a “confirmation letter” shows that a foreign worker is needed to fill the current vacancy and that no Canadian is equipped to do the job.


Can LMIA be rejected?

Yes, an employer’s LMIA application can be rejected if the Canadian government finds out that hiring a foreign worker for the position can have more damaging than a positive effect on developing a robust Canadian economy.


How long is an LMIA valid for?

The LMIA is valid for 6 months.
